THEFT:

Theft is to wrongfully obtain or exert unauthorized control over the property or services of another or the value thereof, with intent to deprive him or her of such property or services. Depending on the circumstances the potential punishment ranges from a misdemeanor to a felony.

RCW 9A.56

Theft in the First Degree
This charge is filed when the alleged theft is for property with a value above $1,500 (other than firearm); is a motor vehicle; or search and rescue dog. This crime is a class B felony.

Theft in the Second Degree
This charge is filed for alleged theft of property with a value between $251 and $1,500 and is not a firearm or motor vehicle. This crime is a class C felony.

Theft in the Third Degree
This theft charge is for property valued up to $250. This is a gross misdemeanor punishable for one year in jail and a $5,000 fine.

Shoplifting
The value of the goods will determine the degree of Theft that a person may be charged with. The crime of shoplifting carries potentially additional civil charges under RCW 4.24.230.

Possession of Stolen Property
Persons are charged with this crime when they knowingly receive, retain, possess, conceal, or dispose of stolen property knowing that it has been stolen and to withhold or appropriate the same to the use of any person other than the true owner or person entitled thereto.

First Degree – motor vehicle or value of good in excess of $1,500. This is a class B felony. RCW 9A.56.150

Second Degree – value of goods from $250 to $1,500. This is a class C felony. RCW 9A.56.160

Third Degree – value of goods is less than $250. This is a gross misdemeanor punishable by up to a year in jail and a $5,000 fine. RCW 9A.56.170
